The Emily West BFF Contest ("Contest") begins on Wednesday, July 7, 2010, at 12:01 AM (EST) and ends at 11:59 PM (EST) on Thursday, March 31, 2011, at 11:59 PM ("Contest Period"). The Contest is sponsored by Kahn Lucas ("Sponsor").
Each participant must be between the ages of 4 and 14 at the time the entry is submitted ("Eligible Child"). Entry forms must be submitted by legal residents of the United States who are 18 or older and are the parent or legal guardian of an Eligible Child.
The Contest is open to legal residents of the United States, excluding residents of Puerto Rico and Territories of the United States. The Contest is void where prohibited or restricted by law, and is subject to all applicable federal, state and local laws and regulations. Employees of Sponsor and its affiliates and members of their immediate family or household are not eligible to participate.
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.
Please visit www.emilywest.com to print your entry form. Entries can be submitted by scanning and e-mailing entry forms with supporting materials or video to info@emilywest.com, or by sending entries by mail to Kahn Lucas, 112 West 34th Street, Suite 600, New York NY 10120. All entries sent by mail must be postmarked by March 31, 2011.
All entries must contain an original essay, video, art work, or dress design created by an Eligible Child as to why she should be selected as a Best Friend Forever of Emily West.
The parent or legal guardian must sign the entry form. By signing the entry form, the parent or legal guardian confirms that: (i) he or she has read, understands and agrees to abide the rules of the Emily West BFF Contest; and (ii) the submission is the original work of the Eligible Child and does not contain material that violates or otherwise infringes the rights of any third party, including but not limited to trademarks, copyrights, privacy rights or publicity rights.
Entries become the property of Sponsor and will not be returned. All contestants grant Sponsor and its licensees and assigns an irrevocable, perpetual, and royalty-free right to use, reproduce, edit, display, transmit, prepare derivative works of, modify, publish and otherwise make use of the entry submission throughout the world for any purpose.
All entries will be judged by Sponsor based on creativity and originality. All decisions by Sponsor are final.
Sponsor will select at least one winner by April 15, 2011 (See timing above). Sponsor will arrange for transport within the United States for a Winner and a parent or guardian to visit New York City for a two night stay and provide hotel and food accommodations, in a total amount not exceeding $2500. Sponsor will also host a winner and a parent/guardian at Sponsor's office, make a $1,000 donation to Winner’s school, and provide each Winner with up to $250 of Emily West apparel.
A Winner will be notified by mail, telephone, or e-mail. In the event that a potential Winner cannot be reached or does not respond within five (5) business days from the first attempt to notify Winner, such entrant will be disqualified and an alternate winner will be selected.
The parent or guardian of each Winner will be required to execute an Affidavit of Eligibility and Publicity Release ("Affidavit and Release") on behalf of his or her child. Affidavit and Release must be signed, witnessed and returned by parent or guardian to Sponsor within five (5) business days of receiving Affidavit and Release. Failure to sign, witness and return Affidavit and Release within this time frame will result in forfeiture of prizes.
By accepting the prizes, a Winner and her parents or guardians agree to hold Sponsor, its officers, directors, employees, agents, affiliates, successors and assigns harmless for any injury or damage caused or allegedly caused by participating in the Emily West BFF Contest or by accepting and/or using the prizes.
All prizes will be awarded. Prizes are non-transferable. Any associated taxes are the responsibility of each winner.
Winner(s) will be identified on Sponsor's website at www.emilywest.com by April 15, 2011 (Timing TBD). The name(s) of Winner(s) also can be requested by sending a self-addressed stamped envelope to Kahn Lucas,112 West 34th Street, New York NY 10120, by April 15, 2011.
Any personal information submitted to Sponsor by the parent or legal guardian will only be used to contact the parent or legal guardian in the event his or her Eligible Child is a Winner, or if there is a question or issue regarding the entry submission. Sponsor will not disclose, sell, give or transfer any personal information submitted to Sponsor to any third party, unless required by statute or for law enforcement purposes.
